Sadly I think this show is going to do badly simply because people have this idiotic assumption that it's in some kind of competition with Britain's Sherlock. -_-
I take your point, and I for one am a big fan of the BBC version and so not entirely thrilled by what may well be a pale imitation. However I am also not entirely sure how big a US audience that has? It may be that the majority of people that try Elementry won't have seen it and so will treat it in the way in which it was intended - just another one of a long line of adaptations and it will be judged only by it's own merits. Certainly if you haven't seen the BBC version, then this one does look fresh and fun.
Surely you can see that the use of the word "imitation" isn't right in this situation. If you want to use the word imitation to refer to Elementary, than Sherlock is just a pale imitation of the Sherlock Holmes books. Both Sherlock and Elementary are adaptations and should not be compared to one another at all anyway. The people constantly comparing them and knocking Elementary before they even give it a chance really surprise me too.
