    According to the next sneak peek, he pulled her out of the vehicle so they would not have seen first hand who was driving ... maybe they assumed. Maybe he confessed since he clearly feels guilty. Maybe he couldn't remember if he was driving and he thought he was since he was too toasted to recall. They should be able to explain that away without a problem really. If he had left her in the car, they probably would not have been able to charge him.
