I would say that the ONLY reason why it says season finale (not series finale) is, that they haven't oficially cancelled the show yet. However, all TV sites predict cancellation for Touch. But, if by some miracle, it gets renewed for season 3, I hope Jake won't be killed off in this season finale.
If it gets renewed, it's likely just for another 13 episode order... and that's a HUGE if cause you're right. Frankly, I think part of the reason they've yet to lay the axe down is because of Kiefer Sutherland. He'd be the only reason they'd give the show one more shot.
On a personal note, I'm once again reminded to never fall in love with a Fox show, cause what I like rarely gets more than two seasons.
